Terms of Service

These Terms of Service govern your use of the BLNK / BLNK STATE website and your purchase of products from BLNK.

BLNK is operated by:

By using the website or placing an order, you agree to these Terms.

1. BLNK Products

BLNK creates personalized embroidery based on customer-submitted images, drawings, screenshots, text, and other content.

Because embroidery has physical limitations, BLNK may simplify:

shapes;
colors;
composition;
small details.

The goal is a recognizable BLNK interpretation suitable for thread, not an exact reproduction of every pixel.

2. Orders

You are responsible for checking the information entered during ordering, including:

product;
size;
color;
placement;
uploaded image;
customization instructions;
shipping address.

An order is not ready for production merely because payment has been completed.

Customized orders require design-proof approval before production begins.

3. Proof Approval

BLNK sends a design proof before production.

One design adjustment is included unless otherwise stated.

Production begins only after you explicitly approve the current proof.

Once a proof is approved and production begins, the order becomes a personalized made-to-order item and the cancellation/return limitations in our Returns & Custom Orders policy apply.

4. Customer-Submitted Content

You retain ownership of content you submit, subject to any rights held by third parties.

By submitting content to BLNK, you confirm that:

you own the content; or
you have the necessary permission or rights to use it for your custom order.

You grant BLNK a limited, non-exclusive permission to use the submitted content only as reasonably necessary to:

review the request;
create the design proof;
produce the order;
provide customer service;
handle remakes, disputes, or related order issues.

This operational permission does not automatically give BLNK permission to publish your content for marketing.

5. Public Use of Customer Content

Customer images and custom work are private by default.

BLNK will not automatically publish your submitted image or custom work in the Archive, on social media, or in advertising.

Separate permission is required before using customer content publicly for marketing.

6. Content We May Refuse

BLNK may refuse or cancel a custom request that we reasonably believe:

violates law;
infringes third-party intellectual-property rights;
contains explicit sexual content;
contains graphic violence;
contains political campaign or partisan promotional content;
creates a safety or fraud concern;
falls outside our technical production capabilities.

Where an order is refused before production, an appropriate refund will be issued for amounts paid for the affected item.

7. Intellectual Property

The BLNK name, branding, website design, original photography, original graphics, and other BLNK-created materials are protected by applicable intellectual-property rights.

You may not reproduce or commercially use BLNK-owned materials without permission, except where allowed by law.

Third-party names, brands, or content remain the property of their respective owners.

8. Prices and Payment

Unless otherwise stated:

prices are shown in USD;
shipping charges are shown separately at checkout;
payment is processed through third-party payment providers.

BLNK may correct obvious pricing, technical, or listing errors before fulfillment.

If an error materially affects an order, we will contact you before proceeding.

9. Shipping

BLNK currently fulfills orders from Shenzhen, Guangdong, China and initially ships to the United States.

Shipping times are estimates, not guarantees.

10. Returns, Cancellations, and Defects

Personalized products have different return rules from ordinary stock products.

Please see our Returns & Custom Orders policy.

In summary:

cancellation is allowed before proof approval;
change-of-mind returns or size exchanges are not available after proof approval and production begins;
BLNK remains responsible for qualifying production mistakes, damage, or material differences from the approved proof.

11. Product Appearance

Small differences may occur between:

screen colors and thread colors;
digital proofs and physical embroidery;
garment production batches;
fabric texture and measurements.

These normal manufacturing differences are not defects unless the finished product materially differs from the approved order or is otherwise defective.

12. Website Availability

We aim to keep the website accurate and available, but we cannot guarantee uninterrupted access at all times.

We may update, suspend, or modify site features where reasonably necessary for:

maintenance;
security;
technical issues;
business changes.

13. Prohibited Use

You may not use the BLNK website to:

commit fraud;
upload malicious files;
interfere with website operation;
attempt unauthorized access;
violate third-party rights;
submit unlawful content.

14. Disclaimer

BLNK provides products and website services with reasonable care.

Nothing in these Terms excludes rights or remedies that cannot legally be excluded under applicable consumer law.

15. Limitation of Liability

To the extent permitted by applicable law, BLNK is not responsible for indirect or consequential losses that were not reasonably foreseeable from the purchase.

BLNK's liability for a product claim will not be limited where applicable law prohibits such a limitation.

16. Governing Terms

These Terms are interpreted in connection with the laws applicable to the operator in China, while preserving any mandatory consumer rights that apply to customers under the laws of their jurisdiction.

17. Changes to These Terms

We may update these Terms when our products, services, policies, or legal obligations change.
